Alina Habba has stepped down as the chief federal prosecutor in the state. This decision was prompted by a legal ruling that invalidated her legal standing to occupy the role.

Official Departure

The head of the Justice Department, the Attorney General, accepted her stepping down on Monday. Bondi stated that the court's "flawed" ruling made it unworkable for Habba to perform her duties.

"Do not interpret compliance for surrender," she wrote. "The effort will now reach across America."

Judicial Challenge

The departure comes a week after a US appeals court found that she had been acting without proper authority as the top prosecutor. This ruling is could influence many criminal cases in New Jersey.

The court ruled that a temporary posting that skirted the advice and consent of the Senate violated the statute on vacant positions.

Bondi said that Habba will stay on at the Department of Justice as a senior adviser. She will challenge the decision of the disqualification, with hopes of a overturned decision.

On a social media platform, Bondi wrote that the judiciary "must not override the executive's selection of prosecutors entrusted with performing the primary duty of the administration of enforcing the law."

Habba, 41, first joined Trump's personal legal team in 2021. She went on to defended Trump in his business records case in 2024, leading to his conviction on multiple felony counts of falsifying business records.

Prior to her appointment to the role of US Attorney, Donald Trump had announced he was appointing her as his senior adviser during his second administration, describing the lawyer as deeply loyal and a "tireless advocate for justice".
